Texas Now Has a Point Based System. As of September 1, 2003 Chapter 708 of the Texas Transportation Code entitled "Driver Responsibility Program" went into effect. For each conviction of a moving violation the Texas Department of Public Safety will assign points to an individuals drivers liscense.
Two Points for a moving violation conviction in Texas or that of another state. Three points for a moving violation conviction in Texas or that of another state which resulted in a vehicle accident. Points will not be assigned for speeding if the driver was doing less than 10% over the posted limit or for failure to wear seat belt convictions.
These points will remain on the drivers record for three years.
If you accumulate a total of six points or more in a three year period you will be assessed a fine of $100.00 for the first six points and $25.00 for each additional point.
A single conviction of driving without a valid drivers license will result in a surcharge of $100.00 a year for three years.
Driving with a suspended or invalid drivers license results in a surcharge of $250.00 per year for three years.
All of these surcharges are in addition to any other fines, fees or administrative actions.
Failure to pay surcharges within 30 days after notice is sent by DPS will result in the revocation of driving privileges until the individual pays all surcharges and any related costs.
